Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and DocketPro (“DocketPro”, “we”, “us”) governing your access to and use of the DocketPro mobile app and web admin (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company, and “you” refers to that company.
1. The Service
DocketPro is a business record-keeping and field-operations tool for construction and civil crews. It helps teams create job dockets, complete prestart and safety checklists, manage machines and fleet, and administer team members and roles. DocketPro is a record-keeping and workflow tool only — it is not a substitute for professional engineering, safety, legal or compliance advice.
2. Accounts
- You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.
- Companies are administered by an owner and any admins they designate, who can invite, manage and remove members and control roles and permissions.
- You must be at least 16 years old and use the Service for legitimate business purposes.
3. Your responsibility for records
You are solely responsible for the content you and your team create in the Service, including the accuracy, completeness and legality of job dockets, prestart and safety checklists, fault reports, photos and signatures. DocketPro stores and displays what you enter; it does not verify that records are correct or that safety checks were actually performed. You must not rely on DocketPro as your sole system where law, contract or safety regulation requires independent records or checks.
4. Free trial, subscriptions & billing
- New companies receive a free trial of 10 days from sign-up, with full access and no payment details required. We will notify the company owner by email before the trial ends.
- When the trial ends without a subscription, the account becomes read-only: existing dockets, prestarts and records stay accessible to view, export and print, but new records cannot be created until a plan is taken up.
- Paid features are offered on a subscription basis. Plans, features and pricing are presented on the billing page of this website when you sign in.
- Payments are processed by Stripe. By subscribing, you authorise us (through Stripe) to charge your payment method the applicable fees on a recurring basis until you cancel.
- Subscriptions renew automatically for successive periods unless cancelled before the renewal date. You can manage or cancel your subscription from the billing page or the Stripe customer portal.
- Except where required by law, fees are non-refundable and are exclusive of taxes, which are your responsibility. We may change pricing on reasonable notice, effective from your next billing period.
5. Acceptable use
You agree not to:
- Use the Service unlawfully or to store unlawful, infringing or harmful content.
- Attempt to access accounts, data or systems you are not authorised to access, or probe, scan or breach security measures.
- Reverse engineer, resell, sublicense or copy the Service except as permitted by law.
- Interfere with or disrupt the Service, or upload malicious code, or use it to send spam.
- Upload content or personal information you do not have the right to share.
We may suspend or terminate accounts that breach these Terms or that pose a risk to the Service or other users.
6. Intellectual property
DocketPro and its software, branding and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain ownership of the content you create; you grant us a licence to host, process and display that content solely to operate and provide the Service.
7. Third-party services
The Service relies on third-party providers including Supabase (hosting, database and storage) and Stripe (payments). Your use of those features may also be subject to those providers' terms, and we are not responsible for third-party services outside our control.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that records stored in it are accurate or complete. Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable consumer law.
9. Limitation of liability
To the maximum extent permitted by law, DocketPro will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold DocketPro harmless from claims, damages and expenses arising from your content, your use of the Service, or your breach of these Terms or of applicable law.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you breach these Terms or fail to pay fees. On termination, your right to use the Service ends; sections that by their nature should survive (such as fees owed, disclaimers, limitations of liability and indemnities) will survive.
12. Governing law
These Terms are governed by the laws of [your State or Territory], Australia, without regard to its conflict of laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law gives you the right to bring proceedings elsewhere.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
